Terms & Conditions of Use
At Empire, we work hard to ensure the best possible service to our clients while protecting their intellectual property and providing effective protection against internet abuse. The Empire Design & Development Service Agreement contained below governs the use for you, as the customer, with regard to your web hosting, e-commerce and any other internet related services provided by Empire Design & Development, (hereafter known as Empire D&D). This Agreement is to identify and inform you, the customer, of the Appropriate Use, Billing Terms, Privacy Policy, Anti-Spam Policy and Consequential Actions which are incorporated within Empire D&D Terms and Conditions of Use Agreement. Your signature agreement is required prior to subscribing to our service.

Appropriate Use Policy:
This policy defines the proper conduct and acceptable use of Empire D&D hosting customers. This policy is not exhaustive and Empire D&D reserves the right to update the policy at any time. All Empire D&D hosting customers are required to be in agreement while receiving service by Empire D&D. If the Appropriate Use Policy is infringed upon, Empire D&D reserves the right to suspend or terminate service immediately.
Content Usage:
The customer of Empire D&D hosting service agrees to the following:

Not to violate any state, federal or foreign laws and regulations.

Not publish acts of copyright infringement upon any intellectual property, (ie copyright, trademark or proprietary property of any third party including Empire D&D).

| 3. |
Not publish content that is pirated, such as computer programs or links to such programs and information used to circumvent original manufacturer-installed, devices such as serial numbers and registration numbers. See the Digital Millennium Copyright Act for procedures and notices of such copyright infringements.

| 4. |
Not to participate in publish content that is slanderous, grossly offensive, defamatory, threatening, harassing, promotes hate or is discriminatory based on gender, race or age.
|
| 5. |
Not publish any form of adult content, such as nudity and pornographic material in any manner.
|
| 6. |
Not to produce, publish, distribute or make available computer viruses or other computer programming defects which result in damage to Empire D&D or any third party.

Anti-Spam Policy:
Unsolicited commercial advertisements (spam) by Empire D&D customers is strictly prohibited. Customers are not to participate in practices such as chain letters, unsolicited bulk e-mail, junk mail distribution, spamming or any other list distribution to persons who have not given specific permission to be included in such distribution. See Empire D&D guidelines on securing opt-in permission or e-mail distribution. Empire D&D reserves the right to suspend or terminate the customers account immediately upon an infraction.
The following activities are considered, but not limited to, unsolicited e-mail or spamming:

Distributing unsolicited bulk or commercial e-mail messages (spam). This can come in the form of PR messages, commercial advertising, company informational announcements, request for aid and political or religious information.

Publishing acts of copyright infringement upon any intellectual property, (ie copyright, trademark or proprietary property of any third party including Empire D&D).
|
| 3. |
Repeatedly sending unsolicited e-mail or "mail bombing" with the intent to interrupt a server or an account. |
| 4. |
Providing spamware (software used to send bulk e-mail) or making available such software. |
| 5. |
Distributing e-mail that mentions or makes reference to Empire D&D hosting servers or domain/account on Empire D&D servers. |
Privacy Policy (view)
Payment Policy
All Empire D&D hosting accounts are on a pre-pay basis, meaning, clients are responsible for payment prior to the month of hosting. We work on a simple month to month billing cycle. Set-up fees and initial month hosting fees are due prior to a site being launched on the web.
Empire D&D will bill each client on the 1st or 15th of each month depending upon when their particular service was initiated. Payment by credit card or check is acceptable.
Late payments are in excess of 10 days and accounts with past due amounts will be notified prior to cancellation or suspension. Accounts with a past due amount over 30 days can be suspended or terminated immediately. Empire D&D will refund a pro-rated amount to clients who discontinue service on their own accord.
Empire D&D can terminate the hosting agreement upon notice to individual account. Likewise, any Empire D&D account, may at any time, terminate their hosting agreement. Empire D&D must receive and confirm a written termination notice from an account seeking cancellation of hosting services. Please allow 2-3 days.
Termination / Reinstatement
Empire D&D reserves the right to terminate an account, at any time, if the particular account commits an infraction of the Conditions of Use Policy previously stated. Termination will commence by e-mail notification and followed up with written letter sent to the billing address of the account. The account includes the web site hosting and all e-mail accounts as well as access to the IP.
Accounts that have been terminated may be reinstated by Empire D&D agreement only.
Liability /Idemnification
All Empire D&D web hosting customers will agree to hold Empire D&D harmless for any and all demands, liabilities, loss, costs, claims, attorney fees, prospective profits, sales goals, expenditures or expenses while participating as an Empire D&D web hosting account. Empire D&D will not be responsible for any damages that your business may suffer, warranties, non-deliveries, delays, data loss resulting from ISP activity or internet activity or service interruption of the web hosting customer account.
Empire D&D will relieve a customer's account of any and all future obligation for fees and costs accrued upon following proper termination or cancellation procedures, and the account is paid in full.
